ABC15.com reports that Theodore Curley was shot and killed outside an apartment building in Phoenix, Arizona. The suspect who shot him has now been released based on information that the police used to form the opinion that the shooting was in self-defense. Theodore Curley was 17 years old. This incident occurred on Saturday, January 12, 2013. It was about 11:15 p.m.

The location of the apartment was near 17th Street and Indian School Road. The name of the complex was not given in the article.
At the same time, 18-year-old brothers Mardell and Merrell Curley were arrested for aggravated assault. After Theodore was shot, Mardell and Merrell started throwing river rocks into the windows of the shooter’s apartment.
Was it self-defense?
As with all media reports, there are not enough facts to give a definitive opinion. But according to the report, the shooter and Theodore Curley were involved in some sort of altercation. After the shooter entered his apartment, where he had a girlfriend and baby, Theodore allegedly tried to break in. After warning Theodore to go away, he ultimately shot Curley, saying that he feared for his life and the others in the apartment. At the same time, Curley was also allegedly threatening the shooter.
There is too much missing to give a firm opinion on whether this was legitimate self-defense. If the facts are true, there was certainly a reasonable fear on the part of the shooter. But whether the threat was imminent enough to justify the shooting is not clear from the article. That depends on how close Curley was from breaking in (or had he already broken in?) and the likelihood that he could successfully break into the apartment.
As far as the 18-year-old brothers’ aggravated-assault charges, they do not appear to have much of any defense at all. They could have just walked away and called the police. Instead, they tried to get revenge while taking matters into their own hands.

I personally KNOW Theodore Curley……I won’t say how but very closely and he was in NO WAY trying to break into this man’s apartment. This murderer is NO MAN but a 19 year old idiot. He did not shoot Theo at his apartment NOR outside HIS apartment, but Theo’s mom witnessed everything and her and Theo were coming back INSIDE their apartment when this murderer came out of his apartment with a gun and an INTENTION to kill cuz Theo was walking bk in the door with his mom and the murderer came from his apt. to theirs and shot 2 shots into Theo’s back. YES HIS BACK………….he was leaving it alone and coming back inside and when that happened, Theo and his mom fell to the floor right inside their doorway and Theo was killed instantly. See so whatever this guy is saying is LIES and nto only that but news stations are just trying to get more ratings by giving their accounts of what happened when this is n’t what transpired. This guy was let go from custody and is on the streets knowing he murdered someone who was the SWEETEST person alive and was doing good with his life. I’m sorry, but I do not blame his brothers retaliating against this man and doing what they did. Wouldn’t you????? I WOULD! You seem to think everybody is against this family. The police won’t talk to the mom. Even the media are against them. LOL. And you blame this on being Indian? Jesus. You know the police would know whether someone was shot in the back while walking away and entering their own apartment. And if that’s true, they would have arrested the shooter. Well, unless we believe your groundless theory about the police not wanting to solve a murder case just because the guy killed was Indian.
Try again, Relative2013. And maybe next time, don’t add the media into your conspiracy. They would have MORE to gain with a murder case than the police making no arrest by concluding it was self-defense. That effectively ends the story. With a murder case, they could have potentially years of material to talk about.
To me this sounds all crazy! (Edited by admin) alcohol was involved. The boys are all under legal age to purchase alcohol. Where & how did they obtain the alcohol. If the mother was there, should she not be charged with something too? Especially if the children were consuming alcoholic beverages. How irresponsible is that!
Yes, if this was murder the justice system would definitely have the man behind bars. Maybe the mother of the children cannot keep her story straight either. There is obvious family dysfunction. Relative2013 taking upon the victim posture not knowing the true story or the evidence collected. I question the mother’s level of responsibility level as a mother & a responsible adult. I also question the responsibility and intelligence of the two boys. As for Theodore he was a minor! He was under the responsibility of an adult. Who was the responsible adult at this time? Was Theodore also under the influence of alcohol? If so the mother should be held accountable for involuntary manslaughter!
